In Michigan, joint custody (rather than sole physical custody) is the presumed custody arrangement unless a parent is unfit. More and more, Michigan laws regarding custody are moving toward the notion of parenting time in which both parties have custody of the child. When a child is with a parent, that parent is the custodial parent at the time.
There are several factors that decide custody, including the following:
- Parent's capacity to give love and affection
- Preference of the child
- School, community, friends
- Religion
- Domestic violence
Communication between divorcing parties is important in the development of a parenting plan that offers a flexible alternative to rigid custody arrangements that aren't always the most practical (i.e., choosing daycare over the non-custodial, non-working parent). Parenting time rights consider whether one or both parents are working and allow parties to reach creative solutions and an optimal arrangement.
